The entry procedure of foreign citizens and stateless persons into Ukraine.

To date the Ukrainian legislation defines both visa and non-visa entry procedure for foreigners (foreign citizens and stateless persons) into Ukraine. Entry (departure) of foreigners into Ukraine is regulated by the Ukrainian Law of foreigners’ legal status of the 4th of February 1994; Regulation of foreigners’ entry, departure and transit through Ukraine (Cabinet of Ministers Decree of the 29th of December 1995 N1074) and Regulation of visa registration for entry into Ukraine (Cabinet of Ministers Decree of the 20th of February 1999 N227). Foreigners enter (depart) Ukraine through admission posts on the state border by showing national passport with visa, except cases when a different order of entry is determined by Ukrainian legislation. 

All categories of visas are granted by diplomatic representatives and consulates of Ukraine abroad. On the territory of Ukraine the Consulate Department of Foreign Affairs Ministry grants diplomatic visas for the accreditation term of diplomatic workers, and business visas for foreign affair department workers from foreign countries that have business passports, for foreign mass media workers as well as their family members for the period of their office card duration.

The duration of visa can be prolonged in Ukraine. Diplomatic and business visas granted to diplomatic personnel, workers of diplomatic representatives, consulates, international and other organizations accredited within Ukraine are prolonged by the Consulate Department of Foreign Affair Ministry of Ukraine. Other types of visas are prolonged by the Ministry of Internal Affairs of Ukraine. According to Cabinet of Ministers Decree of the 20th of February 1999 N227 granting visas for foreigners is exercised depending on the purpose of their visit to Ukraine and in the presence of documents corresponding to this purpose.
 
Depending on the period of validity, visas can be short-term granted for the period up to six months, and long-term granted for the period from six months up to one year; single, double, many-times used and collective. During temporary stay in Ukraine foreigners and stateless persons have no right to change their status on any other or turn for inhabitancy permission. 

Since July 1st 2001 according to presidential decree “Concerning additional measures for realization of man’s right for travel freedom and free choice of place of residence” (N435 from June, 15, 2001) the registration of foreigners entering Ukraine and their passport documents is only performed at admission posts by executives of The State Committee on Protection of State Border of Ukraine. Further registration of foreigners who are temporarily in Ukraine on legal grounds and their passport documents by Internal Affairs authorities is not conducted. 

Registrations of foreigners who enter Ukraine for inhabitancy, education, probation and work will be duly performed by the Internal Affairs authorities. 
In case of loss of the national passport on the territory of Ukraine the foreigner should inform the organization that receives him, and Internal Affairs authorities, that would give him a loss reference on his request. After receiving the national passport in the diplomatic embassy or in a consulate of his native country on the request of a foreigner and intercession of the organization that receives him, the issue of visa granting (to depart Ukraine) or national passport registration is resolved. 

The departure procedure of foreign citizens and stateless persons from Ukraine.
Foreign citizens and stateless persons who were temporarily in Ukraine depart by way they entered Ukraine. 
According to Cabinet of Ministers Decree of the 5th of June 2000 #910 foreign citizens and stateless persons who permanently reside in Ukraine or stay in Ukraine for work purposes or study in higher educational establishments of Ukraine, leave abroad by passport documents with appropriate references and residential permits. 

Transit of foreigners through Ukraine is allowed in the presence of transit Ukrainian visa, destination country visa, tickets or other documents that prove transit character of the trip. 
Citizens of countries that Ukraine has international agreements concerning non-visa entry with, can enter Ukraine with a valid national passport in case there is an insurance policy or a duly legalized invitation (original) from legal or natural persons within Ukraine, if the international treaty does not specify otherwise. 
Non-visa entry remains also with UIS countries (according to Agreement concerning non-visa travel of UIS citizens of October 9, 1992) and with Russia and Byelorussia. 

Customs rules
Things, currency and other values that are brought into the customs territory of Ukraine are subject to obligatory declaring. At that the declaration is a written commitment of a citizen to take the declared items out of Ukraine. t is allowed to bring into Ukraine 1 liter of vodka, 2 liters of wine and 10 liters of beer for one’s own needs and without certificate. You can bring back from the territory of Ukraine not more than 2 liters of wine. Food products for the sum up to 50 Euros. 

Rapid customs control method
Special rapid customs control method (“Green” and “Red” corridors system) is applied in cases of bringing in over the customs border of Ukraine items and values that are not liable to declaring and customs taxation, and are not in the category of items that have bans and restrictions when transited through the Ukrainian customs border. 
Passengers that have items liable to obligatory declaration in their hand luggage or baggage, pass through customs registration over the “Red” corridor line, i.e. declaring the items in writing and showing them for inspection. 

Import of foreign currency
Foreign currency is imported by natural persons irrespective of age. It is allowed to orally declare sums in any currency equal to $1.000 as well as checks emitted by foreign banks equal to the same sum. It is necessary to put sums equal to $10.000 or checks equal to $50.000 irrespective of the currency into the customs declaration. No permission documents are required.  
Foreign currency that exceeds the sum of $10.000 is taken for deposit by the customs authorities and is returned to the owner for importing into Ukraine on showing a special National Bank permit. The same rule is applied regarding checks that exceed $50.000. 

Import of valuables
Personal valuables are liable to obligatory declaration. 

Import/export of photo cameras and video cameras
To declare your photo or video camera is your private business, there are no strict rules. But it is recommended to do it though. Import/export of printed materials, clichés, negatives, films, photos, movies and videos etc that propagandize ideas of war, racism, racial discrimination, genocide is strictly prohibited.  

Import of personal vehicles
Foreigners are allowed to temporarily import vehicles for personal needs for the term of up to one year in the presence of written obligation to export it back, and documents proving the registration of vehicle outside Ukraine. At that vehicles that are temporarily imported into Ukraine by non-residents for the term exceeding two months should be registered in Internal Affairs Ministry State Motor Inspection authorities.  

Import of cell phones
Foreign citizens are allowed to import single units of cell phones of standards that are allowed in Ukraine (GSM 900, GSM 1800, NMT). 

Export of souvenirs 
It is allowed to export items that are not a commercial lot (the cost should not exceed 100.000 Euro) from the customs territory of Ukraine without taxation. To import artwork, cultural and historical valuables and other items of great historical and artistic value, permit from the Ministry of Culture is required. If the cultural value is not “significant”, it is enough to show the check from the shop or the art salon where the purchase was made.  

Export of foreign currency
Foreign currency is exported by natural persons irrespective of age. It is allowed to orally declare the export of foreign currency (cash or travel checks) for the sum not exceeding $1.000. The main currency export document is the customs declaration. You have the right to export the same amount of currency you imported. It means that if declared, the non-residents of Ukraine can export the sum not exceeding 10.000 hrivnyas or $5.000 (or equivalent to the sum in any other currency). Thus, on crossing the Ukrainian border it is necessary to demand and fill in the customs declaration form. The declaration is filled in duplicate. The tourist gets one copy with customs inspector stamp, the second copy remains in the customs office.
